Master regulator protein brings plethora of coactivators to gene expression sites

ScienceDaily (June 28, 2012) ? Molecular geneticists call big boss proteins that switch on broad developmental or metabolic programs "master regulators," as in master regulators of muscle development or fat metabolism. One such factor, the Activating Transcription Factor 6? (ATF6?) protein, takes charge following a cellular crisis known as endoplasmic reticulum (ER) stress, which is triggered by the accumulation of misfolded and aggregated proteins.

Molecularly, the ER stress pathway is always poised for action. Inactive ATF6? is normally embedded in cellular membranes, but at the first hint of protein overload, its working end springs superman-like into the nucleus, binds DNA and kicks on a host of target genes whose job is to clear a protein logjam.

Now, in a study published in the June 29 issue of The Journal of Biological Chemistry, and selected as "Paper of the Week" by the journal's editors, a team led by Stowers investigators Ron and Joan Conaway reveal that unlike the real superman ATF6? does not work solo. Using the ATF6? target gene HSPA5 as a probe, they apply mass spectrometry analysis to show that ATF6? recruits a fleet of coactivators to assist in target activation.

"We knew that as a master regulator, ATF6? was needed to turn on downstream genes in the ER stress response," says Ron Conaway, Ph.D., who with Joan Conaway, Ph.D., is co-corresponding author of the study. "Our goal was to determine what ATF6? was bringing with it to these genes' control elements."

"By devising a clever mix of state-of-the-art mass spectrometry and good old-fashioned biochemistry, this study has revealed that ATF6? is a virtual magnet for a wide range of 'A-list' co-regulators," said Michael K. Reddy, Ph.D., who oversees transcription mechanism grants at the National Institutes of Health's National Institute of General Medical Sciences, which partly supported the work. "These co-regulators offer a large array of proteins to target in efforts to control the ER stress response and to treat diseases that result from misfolded proteins."

That task of identifying co-regulators was challenging: labor-intensive molecular techniques the group applied to identify candidate interactors early on were not sensitive enough. At that point, the Conaways turned to their frequent collaborators Proteomics' Center director, Michael Washburn, Ph.D., and Laurence Florens, Ph.D., who heads the Stowers proteomics cores. Both had helped develop a sensitive mass spectrometry approach that can detect protein-protein interactions in highly complex mixtures, a technology known as MudPIT.

The group then set up a test-tube comparison. They genetically engineered a strand of DNA flanking the HSPA5 target gene, the so-called "enhancer" region recognized by ATF6?. They then dipped two identical DNA test strips into respective pots of cellular extracts -- one containing ATF6? and one not -- reasoning that factors in the ATF6? entourage would be recruited to the first but not the second. They then applied a single run of MudPIT to identify each ATF6?-specific partner.

In short, they found that it takes not a village but a metropolis to activate an ATF6? target. Many proteins bound the enhancer in both samples, meaning either that they're just background, or else that they must bind DNA even when the gene is inactive. But more than 40 were present in about 5-fold excess only in ATF6??spiked samples, suggesting they are tethered to the enhancer by ATF6?.

Among the latter were components of a multi-subunit behemoth protein known as Mediator, which bridges specific genetic switches (like ATF6?) and the catalytic machinery that copies a gene. Other proteins recruited by ATF6? through overlapping but not identical domains belonged to other large complexes known as SAGA and ATAC, which enzymatically relax chromosome structure to allow gene expression.

Researchers know that all DNA-binding factors partner with other proteins to switch genes on or off. What is remarkable here is their sheer number. "It would be very interesting to find out whether this is the norm," says Ron Conaway. "This work raises a ton of little questions about mechanism."

Among them is how do ATF6?-interacting factors arrange themselves on the test strip, and does a single ATF6? bind to all of them at once? "There are three separate ATF6? binding sites on the HSPA5 enhancer and ATF6? itself forms a dimer," explains Dotan Sela, Ph.D., a Conaway lab postdoc and the study's first author, "So potentially within this region there could be as many six activation domains," he explains.

Solving these puzzles could reveal molecular targets for seemingly unrelated diseases. While a little ATF6? signaling is absolutely essential for cellular housekeeping, unrelieved ER stress is a hallmark of neurodegenerative conditions like Alzheimer's and Huntington's Diseases and is correlated with insulin insensitivity and type II diabetes.

A direct role for ATF6? in what some now call "misfolded protein diseases" is unclear. Nonetheless, the study suggests ways to dampen ER stress signaling molecularly. "We show that the Mediator is relevant to HSPA5 expression," says Sela. "So one way to keep ATF6? from turning on a gene might be to devise ways to block binding of the Mediator to ATF6?."

Joan Conaway also points out that MudPIT data analysis does not require previous identification of a "suspect." "Our approach complements methods that test candidate interactors one by one," says Joan Conaway. "Because the analysis is unbiased, it could reveal novel proteins interacting with a particular enhancer, which then could be confirmed using other methods."

The Conaways began their pioneering studies of mammalian gene expression over three decades ago, when only laborious biochemical techniques were available. As a result, both deeply appreciate what a technological leap the current work represents. "This study provides proof of principle for the utility of mass spectrometry in defining novel transcriptional activators," says Ron Conaway. "We want to compare this data with that from other activators -- it's what we will be working on in the future."

In addition to Washburn and Florens, Lu Chen of the Conaway lab and Skylar Martin-Brown of the Washburn lab also contributed to the work.

Supreme Court Backs Much of Controversial Health Reform Law

THURSDAY, June 28 (HealthDay News) -- Surprising many legal scholars, the U.S. Supreme Court upheld on Thursday the constitutionality of most of the controversial health reform law that requires almost all Americans to have health insurance or pay a penalty in the form of a tax.

The Patient Protection and Affordable Care Act, the signature legislative achievement of President Barack Obama's administration, has been fiercely debated since its inception in March 2010. On one side of the argument have been many Democrats, who view the law as the first substantive legal attempt to greatly expand the number of insured Americans while improving health care and attempting to contain medical costs. On the other side have been many Republicans, who view the measure as an unprecedented intrusion into the private lives of citizens by telling them they have to buy a certain product -- in this case, health insurance.

Chief Justice John Roberts announced the court's complicated 5-to-4 decision that allows the law to proceed with its goal of covering more than 30 million uninsured Americans.

The Associated Press reported that the court did have some concerns with the law's expansion of Medicaid, the government-funded insurance program for low-income Americans. But the court said the expansion could go forward as long as the federal government doesn't threaten to withhold states' entire Medicaid allotment if they don't take part in the law's extension, the news service said.

The court's four liberal justices, Stephen Breyer, Ruth Bader Ginsburg, Elena Kagan and Sonia Sotomayor, joined Roberts in the decision. Justices Samuel Alito, Anthony Kennedy, Antonin Scalia and Clarence Thomas dissented, the AP reported.

The law set in motion a series of reforms designed to extend health coverage to more than 30 million uninsured Americans. It seeks to accomplish these goals in several ways. More lower-income people will be allowed to enroll in Medicaid, while other uninsured individuals can buy coverage through new state health insurance exchanges. Some people who buy coverage may qualify for tax credits.

The 2010 law's most controversial component -- and one of the key targets of the Supreme Court's scrutiny -- requires almost all Americans to maintain health insurance coverage or pay a penalty in the form of a tax.

The law also aims to improve the quality and efficiency of health care. For example, there are programs to improve care coordination and reduce fraud and abuse in Medicare, the government-run insurance program for older and disabled Americans.

A number of the law's most popular provisions are already in effect. For instance, parents in private insurance plans that offer dependent coverage can keep their adult children on the plan up to age 26. And most plans must now cover preventive health screenings, such as mammograms and colonoscopies, at no out-of-pocket cost to the patient.

Core elements of the law -- such as expanding Medicaid, establishing the state health insurance exchanges and requiring people to have coverage or pay a penalty, known as the "individual mandate" -- aren't scheduled to take effect until 2014.

Polls have shown that Americans remain sharply divided over the health care law. But a Harris Interactive/HealthDay poll in January found that an increasing number of Americans were slowly starting to embrace some key components of the legislation.

To be sure, Americans remain divided over the legislation, with slightly more than one-third (36 percent) of adults saying they wanted the law repealed and 21 percent saying they wanted it to remain as is. Another 25 percent said they'd like to see only certain elements of the law modified, the poll found.

"The public is still divided, mainly on partisan lines, as to whether to implement or repeal all, parts, or none of the health care reform bill," said Harris Poll Chairman Humphrey Taylor.

The poll found that support for the legislation broke down along party lines. Almost two-thirds of Republicans (63 percent) said they wanted the Patient Protection and Affordable Care Act repealed, compared to 9 percent of Democrats.

But while respondents were split about the law as a whole, many strongly supported key elements of the bill, with 71 percent of those polled now backing the provision that prevents insurance companies from denying coverage to those already sick, for example.

The notable exception remains the individual mandate [the requirement that all adults purchase health insurance], "which remains deeply unpopular," Taylor said.

In February 2011, the Congressional Budget Office estimated that savings from the Affordable Care Act would cut the federal deficit by $210 billion during the next decade.

The law's supporters argue that without the requirement that people have insurance coverage while they're healthy, there won't be enough money in the risk pool to pay to take care of them when the need for health care eventually -- and inevitably -- arises.

"If people don't feel like paying, then get sick and go to the emergency room or the hospital, those people's costs will be added on to our insurance bills as they are today, which makes it much more expensive," said John Rother, president of the National Coalition on Health Care, which works to achieve reform of the U.S. health-care system.

But opponents say that the cost-cutting provisions probably won't work.

Devon Herrick, a health economist at the free-market National Center for Policy Analysis, said the law set up a "slippery slope" that will increase costs, not lower them.

"If Congress and company have the legal authority to decide the minimum coverage you must have, all manner of lobbyists and special interests and providers for specific diseases will descend on Washington and state capitals, as they always have, to make sure that their respective services are covered by that mandate," Herrick said.

In the two years since its passage, the Affordable Care Act has been the target of multiple lawsuits, with a handful of cases working their way through the federal appellate court system before the Supreme Court heard oral arguments in March.

In their Paris debut, the fashion label Band of Outsiders is claiming to have pulled off the longest fashion show in history. The presentation ? which featured a male model living in a shop widow ? began Wednesday and wrapped up Friday evening, 60 hours later.

Live-streamed on the Internet for three days and four nights, it became somewhat of a phenomenon, receiving 25,000 unique hits, according to designer Scott Sternberg.

The Los Angeles-based Sternberg said the unusual idea came about out of solidarity with anti-capitalist protesters.

"I built in the idea of a sit-in," said Sternberg.

Sternberg decided that every 90 minutes, his model had to disappear briefly to change into a new outfit from the collection ? making the event more like an installation than a fashion show.

"I am a clothing designer, but the line between art and fashion is blurred," said Sternberg. "For what I do, a runway isn't valid."

The model had to sleep in the tiny space.

"He actually enjoyed it," quipped Sternberg. "We did feed him."

Tasers don't cause cardiac complications, study suggests

ScienceDaily (June 28, 2012) ? Taser shots to the chest are no more dangerous than those delivered to other body locations, according to a new study by one of the country's leading experts on the devices.

William P. Bozeman, M.D., an associate professor of emergency medicine at Wake Forest Baptist Medical Center, and colleagues reviewed 1,201 cases of real-life Taser uses by law enforcement agencies but found none in which the devices could be linked to cardiac complications, even when the Taser probes landed on the upper chest area and may have delivered a shock across the heart.

Their findings are published online this month in the Journal of Emergency Medicine.

"While we know that the Taser is a very effective and remarkably safe weapon for law enforcement use, we also continue to have some concern about injuries that may be related to it," Bozeman said. "However, in this review, we found no cases where there was an apparent cardiac complication related to the Taser, even in the worst-case scenarios when the probes landed across the front of the chest and the heart may have been in the path of the electrical current produced by the device."

The team of researchers led by Bozeman reviewed cases of Taser use against criminal suspects by law enforcement officers from agencies across the country. Of the 1,201 cases reviewed, 178, or 22 percent, involved the device's probes landing on the suspect's chest and delivering an electrical charge that may have traveled across the heart area. The majority of the suspects in the reviewed cases were male (94 percent) and the mean age was 32. None of the suspects with Taser shots to the chest were found to have heart-related complications, and they did not have a higher injury rate than suspects with Taser shots elsewhere on the body.

Bozeman said it was important to conduct this research because concerns have been expressed that Taser activations across the front of the chest might be unsafe and should be avoided due to the possibility of probes landing near the heart. It also was important to look at real-life situations, he added, because criminal suspects are thought to be at a higher risk of complications than healthy volunteers because of the stress of the situation, the possible presence of drugs, underlying medical conditions and a variety of other factors.

"This analysis was done to assess whether medical data shows these concerns to be valid and whether law enforcement officers should change how the Taser is used in the field due to possible medical risks," Bozeman said. "The study results indicate that no adverse effects were seen that could be related to transcardiac conduction of Taser shocks."

Tasers are commonly used by law enforcement personnel worldwide as an intermediate-force option to subdue and apprehend potentially dangerous or combative suspects. Tasers function by delivering a series of very brief high-voltage, low-current electric pulses that result in pain, muscle contraction and inhibition of voluntary movement.

Bozeman has been conducting research into the use of Tasers by law enforcement personnel since 2004. In 2007 and 2009 he released results from the first large, independent study of injuries associated with Tasers, finding that they are relatively safe and pose minimal risk of injury. In that study, findings showed that 99.7 percent of those subjected to a Taser had no injuries or only mild ones, such as scrapes and bruises.

In a related study also released in 2009, Bozeman evaluated the immediate cardiac and cardiovascular effects on a group of volunteer police officers, finding that Taser exposure overall was safe and well tolerated. No adverse cardiac affects or rhythm changes were seen.

"This study adds to the accumulated medical evidence that Tasers are safe and effective and that their risks overall are extremely low," Bozeman said. Sandusky could keep $59,000 pension despite conviction

Former Penn State assistant football coach Jerry Sandusky, convicted of 45 counts of child sexual abuse, could still profit from his public pension.

Sandusky stands to collect $58,898 each year, according to PennLive.com, because the crimes he committed are not included on the list of 22 that would force him to give up his benefits.

Pennsylvania's public officials or retirees are required to forfeit their pensions under the State Employees' Retirement System (SERS) if they commit "certain crimes that breach the member's duty of faithful and honest public service." The list does not include sex crimes.


"I think it is nauseating that a convicted pedophile like Sandusky will be collecting a pension while sitting behind bars," Pennsylvania Rep. Brendan Boyle said in a statement. "He certainly doesn't deserve to continue to enjoy the benefit of a taxpayer-funded pension."

Upon his death, Sandusky's wife, Dottie, would be able to get half of the annual payout, PennLive.com reported.

Nicholas Maiale, chairman of the SERS board, told PennLive.com that he will get a legal review of the board's options in this case.?"I am a Penn Stater and I am a citizen of Pennsylvania, and we are all morally outraged about this case and what happened to those kids,? he said, though he is not optimistic?about a forfeiture.

Retired Penn State Vice President Gary Schultz, meanwhile, could lose his pension after being accused of perjury, PennLive.com reported.

Rep. Boyle introduced a bill in 2011, before Sandusky was charged, that is now one of six bills that could broaden the list of crimes that require public workers to give up their pensions, PennLive.com reported.

Sandusky?s sentencing is expected in about three months.

Michigan mulls joint state-federal health exchange

LANSING, Mich. (AP) ? Republican Gov. Rick Snyder's administration is considering partnering with the federal government to run a health insurance exchange because Michigan is running out of time to set up its own if the U.S. Supreme Court holds up one of the key provisions of the federal health care overhaul.

Michigan House Republicans have refused to let state officials use $9.8 million in federal planning dollars to start setting up the MI Health Marketplace, saying they're waiting to see whether the court strikes down any or all of the Affordable Care Act on Thursday.

But state Licensing and Regulatory Affairs director Steve Hilfinger, who Snyder tasked last year with creating the state's online insurance marketplace, has warned for months that Michigan could run out of time to get a state health exchange approved by January as the federal law requires. Snyder is one of few Republican governors to acknowledge considering a possible state-federal partnership to get an exchange in place.

"I'm just trying to be a pragmatist here," Snyder told The Associated Press on Tuesday.

Snyder has expressed support for the idea of a health insurance exchange that would set up a way for small businesses and individuals to compare private health insurance policies and buy them online, much as they would shop for an airline ticket or hotel room. But he wants to give a nonprofit company the authority to set up the exchange and have it running by 2014.

State officials have estimated more than a half-million Michigan consumers would purchase a private policy through an exchange once it's up. About 1.27 million Michigan residents ? 13 percent ? didn't have health insurance in 2010, according to the U.S. Census Bureau.

The state so far hasn't been able to do the detailed information technology work required to map out an exchange. If the health insurance exchanges are upheld by the Supreme Court, Michigan and other states would have to apply for additional funds to get the marketplace up and running. The last day to apply for those funds is Friday, but later grant application dates are expected to be set.

Michigan has been planning for a state exchange as much as possible with $1 million from an earlier federal grant, said licensing and regulatory spokesman Mario Morrow. But it also has been talking to federal officials about setting up a federal exchange where the state handles just some of the responsibilities, such as customer service.

"A state-based exchange is still our preferred option, and we think there is still a path to get there even after the Supreme Court rules," Morrow said. "But we are preparing for all eventualities because the current federal timelines are so tight."

GOP House Speaker Jase Bolger, who has opposed funding an exchange plan before the Supreme Court ruling, would prefer to not partner with the federal government, spokesman Ari Adler said.

"He would prefer that there not be one, but if there is going to be one, it would be better if the state controls setting it up instead of letting the federal government do that," Adler said. Still, Adler said he believes "the speaker and others are open to listening to the governor's ideas."

Michigan Attorney General Bill Schuette, meanwhile, thinks a decision to throw out the federal law's requirement that nearly all citizens buy health insurance would be a huge victory. Schuette views the individual mandate as "an unconstitutional overreach," and many Republicans agree with him. Polls show the mandate also is unpopular with voters.

But hundreds of thousands of Michigan residents already have benefited from the law, and could see those benefits disappear of it is struck down.

More than 23,000 Michigan seniors and people with disabilities have saved $17.6 million this calendar year on prescription drugs because of the law, an average of $757 per person, according to federal statistics. The money goes to help residents with medical costs after they hit the Medicare Part D prescription drug coverage gap, the so-called "doughnut hole."

More than a half-million Michigan seniors have received a free preventive health care service so far this year, 1.8 million residents now receive preventative services with no co-pay and 57,000 more young adults in Michigan under the age of 26 are on their parents' health insurance plans because of the federal law.

Last week, U.S. Health and Human Services director Kathleen Sebelius visited Detroit to announce $3.7 million in grants for six Michigan health centers to help expand access to care for 59,431 additional patients.

In addition, 114,000 Michigan residents will get $13.9 million in rebates from insurance companies this summer because of a rule that requires insurance companies give rebates if they don't spend at least 80 percent of consumers' premiums on medical care and quality improvement. The rebates will average $214 for 65,000 Michigan families.

Reality TV sweetheart Catelynn Lowell sets the record straight after learning the truth behind In Touch?s story reporting that she and her fianc?, Tyler Baltierra, were happily expecting a child.

?I want to set the record straight. I?m not pregnant,? Catelynn told In Touch in an interview on June 23 at the four-bedroom Victorian home in St. Clair, Mich., where she lives with Tyler, her father David Lowell, her brother River and their five dogs. ?My mom lied.?

The shocking deception started in early June, when Catelynn?s mother, April Baltierra, told In Touch Catelynn was pregnant. After arranging for a longtime family friend, Jamie Pyrzewski, to do an interview about Catelynn?s condition and for Catelynn to then corroborate everything herself, April also sent documentation of the pregnancy from a local doctor, claiming she had obtained it from her daughter.

?I love my mom, but it?s frustrating,? says the soft-spoken college student. But her fianc? has more choice words: ?We feel violated,? Tyler tells In Touch. ?I?m shocked that she would go to this length. It just crosses the line.?

In perhaps the strangest twist, a woman identifying herself as Catelynn did a phone interview with In Touch (from a cell phone with Tyler?s voicemail on it), confirming her pregnancy and sharing details of everything from her initial anxiety over the home test to her hopes for her baby?s future. Not only does the Teen Mom deny doing the interview, an independent voice analysis by a private investigator revealed ?with beyond a reasonable degree of professional certainty? that the voice of the interview subject ?is the voice of the mother.?

?I don?t know how she can sleep at night,? Catelynn's father, David, tells In Touch of his ex-wife.

For her part, April still insists her daughter is pregnant ? going so far as to warn In Touch not to contact Catelynn after the hoax was exposed because stress could cause her to ?lose the baby.? In a series of angry phone calls and texts, April revealed that she is homeless and maintains that ?Catelynn was fully aware of the story. She knew all about this.?

But Catelynn says it was all an elaborate con. In the on-the-record interview with Catelynn?s "friend" Jamie, she told the magazine that Catelynn was ?beyond bliss? and ?couldn?t wait to hear [the baby?s] heartbeat.? Catelynn says she barely knows Jamie, who also goes by another last name and is very close with April, adding, ?I used to see her once in a while when we were kids. I don?t even like her.?

Catelynn wants fans to know she?s ?absolutely sorry? for everything that has happened and despite her mother?s hurtful and erratic behavior, Catelynn still maintains, "I?ll always love her.? And one happy side effect of all the crazy drama? Tyler Perry makes his debut as James Patterson's iconic detective and forensic psychologist in the first official trailer for "Alex Cross," which premiered exclusively on Amazon Tuesday (June 26). Previously played by Morgan Freeman in "Kiss the Girls" and "Along Came a Spider," Cross gets a younger makeover in the Perry-starring flick, as well as an impossibly ripped homicidal-maniac nemesis in the form of "Lost" veteran Matthew Fox.

The trailer is all kinds of bonkers, with Fox shouting out sadistic one-liners and threatening women like it's his job (in this case, it actually is) and Perry doing everything he can to hold it together while going up against one of the most ruthless psychopaths this side of Madea. Keep reading for five key scenes from the trailer!

Tyler Perry's Alex Cross
If there's one word to describe Perry's take on the sharp-minded detective, it's "smooth." The trailer introduces us to a cool and composed Alex sipping drinks with his wife; she needs some convincing to leave Detroit and join Cross on his next assignment. His proposed method of getting her to come with him? "The National Guard and a drink." You had me at "the"!

He Had to Go Back
Fox wholeheartedly embraces his inner Heath-Joker in the "Alex Cross" trailer, playing Michael "The Butcher" Sullivan, a killer who is "fascinated by pain." Cross determines that Sullivan is "ex-military, special forces, judging by his tactics." He's also an Ultimate Fighting Champion, if you can believe it, and has a thing for Doctor Cross' very pretty wife. It's an unusual new shade for the actor most commonly associated with good guys Jack Shephard and Charlie Salinger, but it'll be a fascinating transformation — or train wreck — to behold.

Feel the Burns
Just don't get too distracted by Fox's villainy. Also starring in "Alex Cross" is "Saving Private Ryan" and "Entourage" actor Edward Burns as Cross' partner, Tommy Kane. It's weird seeing Burns in a third-tier role at best; as a writer and director by trade, he tends to be somewhat choosy with his acting roles. (Ignore that "27 Dresses" credit.) So I'm calling it now: Burns is the real bad guy pulling Fox's strings. Then again, I incorrectly called Jeremy Renner as the secret "Mission: Impossible" villain and Jared Harris as a red herring for the real Moriarty in the last "Sherlock Holmes" movie, so take my predictions with a half-cup serving of salt.

Matthew Fox and the Chocolate Factory
Watch at around the two-minute mark as Fox gets his high-tech Augustus Gloop on. If you need further reasons to see "Alex Cross" when it hits theaters this October, I don't know what to tell you.

To Hell and Back Again
"He won't stop. I've seen his face. I've heard his voice," Perry's Cross warns his wife of Fox's killer. "I will meet his soul at the gates of Hell before I let him take a person that I love!" If there's a better alternate ending to "Lost" or the "Madea" films than Tyler Perry and Matthew Fox battling to the death for Satan's amusement, I haven't heard of it. The trailer's action-packed finale is, in a word, surreal, every bit as oddly enjoyable as the promise of Perry versus Fox sounds on paper. This demonic battle of the ages cannot come soon enough.

Issa challenges Obama executive privilege claim

WASHINGTON (AP) ? With a vote looming to hold Attorney General Eric Holder in contempt of Congress, a House committee chairman is challenging President Barack Obama's claim of executive privilege, invoked to maintain secrecy for some documents related to a failed gun-tracking operation.

Obama's claim broadly covers administration documents about the program called Operation Fast and Furious, not just those prepared for the president. But Rep. Darrell Issa, R-Calif., chairman of the House Oversight and Government Reform Committee that recommended the contempt charge, maintains the privilege is reserved for documents to and from the president and his most senior advisers.

In a letter to the president dated Monday and made public Tuesday, Issa cited an appellate court decision to back his claim and questioned whether Obama was asserting a presidential power "solely for the purpose of further obstructing a congressional investigation."

White House Spokesman Eric Schultz said Tuesday that Issa's analysis "has as much merit as his absurd contention that Operation Fast and Furious was created in order to promote gun control. Our position is consistent with executive branch legal precedent for the past three decades spanning administrations of both parties."

Courts have routinely "affirmed the right of the executive branch to invoke the privilege even when White House documents are not involved," Schultz said.

Some experts agree with the president's view that all executive branch documents are protected from disclosure. Ohio State University law professor Peter Shane, a specialist in presidential power, says executive privilege historically covers documents generated anywhere in the executive branch.

Behind the legal argument is a political dispute. House Republican leaders are pressing for a contempt vote against Holder by Friday, unless they can work out a deal that breaks through the administration's privilege claim.

Holder's offer last week to turn over some documents ? the Justice Department has provided 7,600 records so far ? was rejected by Issa because he contended the attorney general was demanding an end to the committee's investigation.

Ironically, the documents at the heart of the current argument are not directly related to the workings of Operation Fast and Furious, which allowed guns to "walk" from Arizona to Mexico in hopes they could be tracked.

Rather, Issa wants internal communications from February 2011, when the administration denied knowledge of gun-walking, to the end of the year, when officials acknowledged the denial was in error. Those documents covered a period after Fast and Furious was shut down.

In Fast and Furious, agents of the federal Bureau of Alcohol, Tobacco, Firearms and Explosives in Arizona abandoned the agency's usual practice of intercepting all weapons they believed to be illicitly purchased. Instead, the goal of gun-walking was to track such weapons to high-level arms traffickers who long had eluded prosecution and to dismantle their networks.

Gun-walking long has been barred by Justice Department policy, but federal agents in Arizona experimented with it in at least two investigations during the George W. Bush administration before Fast and Furious. These experiments came as the department was under widespread criticism that the old policy of arresting every suspected low-level "straw purchaser" was still allowing tens of thousands of guns to reach Mexico. A straw purchaser is an illicit buyer of guns for others.

The agents in Arizona lost track of several hundred weapons in Operation Fast and Furious. The low point of the operation came in Arizona in 2010, when Border Patrol Agent Brian Terry was killed in a firefight with a group of armed Mexican bandits and two guns traced to the operation were found at the scene.

Issa, in his letter to the president, wrote, "Courts have consistently held that the assertion of the constitutionally-based executive privilege ... is only applicable ... to documents and communications that implicate the confidentiality of the president's decision-making process."

The letter said that while the privilege covers only the president and his advisers, it is a qualified privilege that can be overcome by a showing of the committee's need for the documents.

Shane, the Ohio State professor, said: "Executive privilege is really an umbrella concept that encompasses a variety of privileges. History's most famous claim of executive privilege ? President Richard Nixon's unsuccessful attempt to withhold the Watergate tapes ? was an example of 'presidential privacy privilege.' That privilege covers executive communications when the president is involved."

He said the executive branch historically claims a much broader privilege, the so-called deliberative privilege. That claim tries to protect documents generated anywhere in the executive branch that embody only the executive's internal deliberations, not final policy decisions. The current dispute involves deliberative privilege, he said.

Issa quoted from a 1997 case in the U.S. Court of Appeals for the District of Columbia Circuit in which the court said the privilege should not extend to staff outside the White House in executive branch agencies.

Rather, the court said, it should apply only to "communications authored or solicited and received by those members of an immediate White House adviser's staff" with responsibility for formulating advice for the president.

However, the case which Issa repeatedly cited in his letter distinguishes carefully between the "presidential communications privilege" and the "deliberative process privilege." In that case, the court dealt only with the presidential communication privilege but observed that both the communications privilege and the deliberative privilege are executive privileges designed to protect the confidentiality of executive branch decision-making. It's the deliberative process privilege that Obama invoked in the current dispute over Operation Fast and Furious.

President George W. Bush invoked executive privilege for the first time in his administration to block a congressional committee trying to review documents about a decades-long scandal involving FBI misuse of mob informants in Boston.
